Gutierrez, of Diamond Bar, pleaded guilty to one felony count of vehicular manslaughter with gross negligence and nine felony counts of reckless driving causing injuries. The sentence means Gutierrez will avoid immediate incarceration, but an eight-year prison term will be imposed if he violates the terms of his probation.
The incident occurred on November 16, 2022, when Gutierrez's SUV veered into a group of 76 LA County Sheriff's Academy Class 464 recruits during a training run in South Whittier. Recruit Alejandro Martinez-Inzunza, 27, succumbed to his injuries eight months later, on July 28, 2023. Of the 25 recruits injured, 10 sustained serious injuries.
District Attorney Nathan J. Hochman stated, "Today's plea and sentence cannot undo the devastation of that day, nor will it bring back the life that was lost." He added that the resolution marks a step toward justice and closure for the victims and their families. Detectives concluded after a multi-agency investigation that there was no evidence Gutierrez intentionally caused the crash, determining he fell asleep while driving. This finding contradicted initial claims by former Sheriff Alex Villanueva, who had suggested the crash was an intentional act.
