Eatherly, 28, is being held on a $1.25 million bond after an altercation with Joshua Fox, a disabled Army veteran, escalated into gunfire, leaving both men injured.

According to a social media post by "fud reaper 🪦," Eatherly claims the shooting was in clear self-defense. The post details that Fox initiated contact by taunting Eatherly as he left the courthouse. After a brief exchange, Eatherly reportedly walked away, but Fox allegedly followed him across the street and issued a verbal threat, stating, "I am a combat veteran. You’re not going to be saying all that 'chimpin out' shit around me."

The social media account further asserts that Fox then punched Eatherly, knocking him to the ground and continuing the assault. "Dalton, 𝘧𝘳𝘰𝘮 𝘵𝘩𝘦 𝘨𝘳𝘰𝘶𝘯𝘥, fired shots, striking Joshua in the stomach and shoulder and sending another round into his own arm," the post claimed, arguing this demonstrates Eatherly's compromised position and fear for his life. This account directly contradicts initial reports and Fox's family's statements.

Authorities, including the Montgomery County Sheriff’s Office, confirmed that both men sustained gunshot wounds and were transported to hospitals in stable condition. While officials have not publicly detailed the sequence of events, District Attorney General Robert Nash confirmed the charges against Eatherly. Joshua Fox's wife, Ni Fox, identified her husband as the victim via a GoFundMe campaign, stating he was shot in the stomach and shoulder and is a disabled veteran with other medical conditions.

Eatherly has a history of controversial online behavior, known for livestreaming confrontations and using racial slurs. Days prior to the shooting, he was arrested in Nashville on charges including theft of services and disorderly conduct after an incident at a restaurant. Fox, 31, served six years in the Army and suffers from PTSD, according to his wife. Competing narratives and crowdfunding campaigns have emerged, highlighting the contentious nature of the incident.
